  • Notes For Applicants

    • You can view an electronic copy of the Freedom of Information Act 1992 (FOI Act) on the Office of the Information Commissioner’s website or purchase a copy from the WA legislation website.
    • DFES may request proof of your identity or evidence of consent where you have submitted this application on behalf of another person.
    • Your application will be dealt with as soon as practicable (Section 13(3) of the FOI Act provides 45 days), however, where necessary extensions may be obtained.

    Fees and Charges

            Application Fee

    • Applications seeking your own personal information or amendment of your own personal information are free of any fee or charge.
    • Applications for all other documents attract an application fee of $30.00. This fee cannot be waived and is required to make a valid application.

            Processing Fee

    • The FOI Act and FOI Regulations outline that an agency can impose charges for dealing with an access application. The Office of the Information Commissioner has found that charges may be imposed for:
      • consulting with third parties, if necessary;
      • examining documents, exercising judgment and making decisions on access;
      • deleting exempt matters where appropriate;
      • preparing a notice of decision; and
      • providing access in the manner required.
    • Discounts may be available in certain cases. For example; if you are considered financially disadvantaged and/or are the holder of a pensioner concession card, a reduction in processing charges may apply.
    • If charges apply DFES will send you a statement of payable charges.
    • Where a processing fee applies, the current breakdown is as follows:
      • $30.00 per hour of staff time processing charge
      • $30.00 per hour of staff time photocopying time
      • $0.20 p/photocopy
      • $0.60 per photograph

    • Documents about an emergency incident; including bushfires, building fires and car accidents 
    • DFES holds a number of documents relating to incidents we attend. These may include Incident Reports, Fire Investigation Reports and photos. The cause of a fire may be identified in the Incident Report or Fire Investigation Report.

    • DFES produces an Incident Report when our crews attend an Emergency Incident. The Incident Report contains the date, time, and address of the incident and may contain the cause. As the owner or tenant of a residential property damaged by fire, you may be able to access the Incident Report at no cost.

    • Fire Safety Engineering Documents 
    • DFES may hold Fire Engineering documents for commercial or apartment buildings.
      If you are the owner of the building, or a representative of the owner, you may be able to access copies of these documents outside the FOI Act, by contacting your Local Government.
      If you are seeking multiple documents relating to a large building, we may need to contact you to discuss options to reduce the scope. If we are unable to reduce the scope sufficiently, we may refuse to deal with your application under section 20 of the FOI Act.

    • As the owner or a representative of the owner, you may be able to access copies of these documents outside the FOI Act, by contacting your Local Government.

    • The documents you seek may include information about other people or organisations. Sections 32 and 33 of the Freedom of Information Act 1992 require DFES to consult those people or organisations before we release this information to you. We may be able to finalise your application more quickly if you agree to exclude this information from any documents released to you.

      Disclosing your name to a third party we consult for your application may allow the finalisation of your application more quickly as third parties are generally more willing to consent to the release of personal and/or business information if the applicant is known.
